“It’s a shame. It’s a horrible tragedy,” the president said when asked about Clancy’s case during an executive order signing ceremony in the Oval Office.
The jury remained deadlocked Friday after hearing five weeks of testimony and deliberating for seven days over whether to hold Clancy criminally responsible for killing her three young children in 2023. After Judge William Sullivan declared a mistrial, her defense team tried and failed to appeal the decision — leading to jurors’ dismissal.
The defense argued the Massachusetts mother was experiencing postpartum psychosis when she fatally strangled her three young children, making her unable to be held criminally responsible for their deaths. The prosecution claimed she acted methodologically while killing her kids — waiting for her husband to leave the house before committing the murders.
In a Friday note to Sullivan, the jurors wrote, “It is with a heavy heart we are still unable to come to a decision and will not be able to.”
The note came a day after Clancy’s lawyers requested the removal of a holdout juror who they said refused to follow the judge’s instructions.
“It’s a terrible situation,” Trump told reporters. “Look, she did a horrible, horrible thing. Can’t be worse, but you’ll find out what the price to pay is. There’ll be a price. It’s going to be mental institution or jail or something, but I guess they’re going to go through another trial. It’s too bad.”
The prosecution now has the option to retry the case in front of a different jury, negotiate a plea deal or drop the charges entirely. Plymouth County District Attorney Tim Cruz said Friday the prosecution’s decision would be announced “shortly.”
Clancy will return to a psychiatric facility until a status hearing scheduled for the end of this month.
